Definitions

Throughout these Terms, the following words have the meanings set out below:

• Project / we / us - the anonymous development team operating the $TSUN project and its associated services.
• Services - the website at tsunonton.com, the Telegram mini-app clicker game, the Telegram bot (@tsunonton_bot), and all related channels and communications operated by the Project.
• $TSUN / Token - the $TSUN cryptographic token deployed on the TON Blockchain at the contract address published on tsunonton.com.
• Tsun Points - in-game points accumulated through gameplay within our Telegram mini-app. Tsun Points are not tokens, not currency, and carry no monetary value.
• Airdrop - a future planned distribution of $TSUN tokens to qualifying participants as described in the Project roadmap, subject to the conditions in Section 7.
• User / you - any individual or entity accessing or using any of the Services.
• TON Blockchain - The Open Network, a public, permissionless blockchain.
• Wallet - a self-custodied software or hardware wallet compatible with the TON Blockchain.

Acceptance of Terms

By accessing or using any part of the Services, including visiting the website, interacting with the Telegram bot, playing the clicker game, or purchasing $TSUN on any exchange, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you are accessing the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case you refers to that entity.

These Terms constitute the entire agreement between you and the Project with respect to the Services and supersede any prior agreements or understandings.

Eligibility and Restricted Persons

By using the Services, you represent and warrant that:

• You are at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher.
• You have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• Your use of the Services does not violate any applicable laws or regulations in your jurisdiction.
• You are not a citizen or resident of a jurisdiction where cryptocurrency activities, token purchases, or participation in airdrops are prohibited or restricted by applicable law.

The Project reserves the right to restrict access to the Services from any jurisdiction at its sole discretion, without notice, where it determines that legal or regulatory risk exists.

Description of Services

The Project provides the following Services:

• Informational website - tsunonton.com provides information about the $TSUN project, tokenomics, roadmap, and instructions for purchasing $TSUN on third-party exchanges. The website is for informational purposes only and does not constitute financial, investment, or legal advice.
• Clicker game (Telegram Mini-App) - a free-to-play game accessible via Telegram in which users accumulate Tsun Points. The game is provided as-is and may be modified, suspended, or discontinued at any time.
• Telegram bot (@tsunonton_bot) - a notification and utility bot for game updates, launch announcements, and airdrop information.
• Community channels - Telegram community spaces for discussion and announcements. Participation in community channels is subject to community rules and Telegram terms of service.

The Services are provided on a best-effort basis. We make no guarantee of uptime, availability, or continuity of any Service.

The $TSUN Token - Risk Acknowledgement

By interacting with $TSUN in any way, you acknowledge and agree that:

• No investment promise. $TSUN is a community meme token with a GameFi utility layer. The Project makes no promises, guarantees, or representations regarding the future price, value, or performance of $TSUN.
• Not a security. $TSUN is not intended to be, and should not be construed as, a security, investment product, share, bond, or financial instrument of any kind in any jurisdiction.
• Speculative risk. Cryptocurrency markets are highly volatile. You may lose some or all funds used to purchase $TSUN. Only invest what you are fully prepared to lose.
• No refunds. All token purchases are final and irreversible by the nature of blockchain technology. The Project cannot reverse or refund any transaction.
• Liquidity risk. $TSUN is listed on decentralized exchanges with limited liquidity. You may not be able to sell your tokens at a price you find acceptable, or at all.
• Smart contract risk. While the contract has been renounced and liquidity locked, smart contracts may contain vulnerabilities. The Project is not responsible for losses resulting from smart contract exploits.
• Regulatory risk. Cryptocurrency regulation is evolving rapidly. Future regulatory actions may adversely affect the value, transferability, or legality of $TSUN in your jurisdiction.
• DYOR. You have conducted your own independent research and due diligence before purchasing or interacting with $TSUN.

The Game and Tsun Points

The Tsunonton clicker game is a free-to-play Telegram mini-app in which users interact with the Tsun-chan mascot to accumulate Tsun Points, complete quests, and rank on a leaderboard.

You acknowledge and agree that:

• Tsun Points have no monetary value. Tsun Points are virtual, in-game items only. They cannot be traded, transferred, sold, or redeemed for cash or any other financial instrument. They exist solely within the game environment.
• Tsun Points are not tokens. Tsun Points are entirely separate from $TSUN tokens. Accumulation of Tsun Points does not automatically entitle you to $TSUN tokens or any financial benefit.
• Leaderboard eligibility. Your position on the leaderboard at the close of Phase 2 may qualify you for airdrop consideration subject to the conditions in Section 7. Eligibility criteria may be adjusted at the Project discretion.
• Game modifications. The game, its mechanics, scoring rules, quest system, and reward structure may be modified at any time without prior notice.
• No guarantee of game continuity. The game may be suspended or discontinued at any time. Tsun Points accumulated in a discontinued game carry no claim against the Project.
• Fair play. You agree not to use bots, scripts, exploits, or any automated means to interact with the game. Detected cheating will result in permanent disqualification from leaderboard rankings and airdrop eligibility.

Airdrop

The Project plans a Phase 3 airdrop distribution of $TSUN tokens to qualifying participants. You acknowledge and agree that:

• No guarantee. The airdrop is a stated intention, not a contractual obligation. The Project reserves the right to modify, delay, reduce, or cancel the airdrop at its sole discretion without liability to any user.
• Eligibility criteria. Airdrop eligibility is expected to be based on leaderboard position at the close of Phase 2. Specific criteria, snapshot dates, amounts, and distribution mechanics will be announced by the Project prior to distribution. The Project reserves the right to change eligibility criteria at any time.
• KYC and compliance. The Project may require identity verification or compliance checks prior to airdrop distribution in order to comply with applicable law. Failure to satisfy such requirements may result in forfeiture of airdrop allocation.
• Tax obligations. Receipt of airdropped tokens may constitute a taxable event in your jurisdiction. You are solely responsible for determining and fulfilling any tax obligations arising from participation in the airdrop.
• Wallet provision. You are responsible for providing a valid, accessible TON-compatible wallet address for airdrop distribution. The Project is not responsible for tokens sent to incorrect or inaccessible wallets provided by you.
• Not a security offering. The airdrop is not intended to constitute an offer, sale, or distribution of securities. Participants should seek independent legal advice if uncertain about the regulatory classification of airdropped tokens in their jurisdiction.

Wallet Connection and TON Connect

Certain features of the Services may offer an optional wallet connection via the TON Connect protocol. By connecting a wallet, you acknowledge that:

• Connecting your wallet grants the Services read-only access to your public wallet address only. We cannot view private keys, seed phrases, or initiate transactions without your explicit approval.
• The Services will never request your seed phrase or private key. Any prompt requesting this information is fraudulent.
• You are solely responsible for the security of your wallet, seed phrase, and private keys. The Project is not liable for any loss arising from your failure to secure these credentials.
• Wallet connection is entirely voluntary. Core informational features of the website function without a connected wallet.
• You should only connect a wallet you own and control. Connecting a wallet belonging to a third party without authorization may violate applicable law.

Prohibited Conduct

You agree not to engage in any of the following when using the Services:

• Violating any applicable local, national, or international laws or regulations.
• Using bots, scripts, crawlers, automated tools, or any non-human interaction with the game or website for the purpose of gaining unfair advantage, inflating scores, or disrupting Services.
• Attempting to hack, exploit, reverse-engineer, or otherwise tamper with the website, game servers, Telegram bot, or smart contracts.
• Creating false or misleading impressions about $TSUN, including coordinated artificial price manipulation (pump and dump), spreading misinformation, or impersonating the Project team.
• Harassing, threatening, or abusing other community members in Telegram channels or other Project spaces.
• Using the Services to facilitate money laundering, tax evasion, fraud, or any other illegal financial activity.
• Attempting to circumvent the geographic restrictions set out in Section 3.
• Posting spam, phishing links, or malicious content in community channels.
• Reproducing, distributing, or commercially exploiting Project content without prior written permission.

Violation of these prohibitions may result in immediate and permanent suspension of your access to all Services, disqualification from airdrop eligibility, and, where appropriate, referral to relevant law enforcement authorities.

Intellectual Property

All content on tsunonton.com, including but not limited to the Tsun-chan mascot design, illustrations, website design, code, text, graphics, and branding, is the property of the Project or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, sublicense, publicly perform, publicly display, or create derivative works from any Project content without prior written permission from the Project, except as expressly permitted by these Terms or applicable law.

User-generated content posted in community channels remains the property of the respective user. By posting in Project channels, you grant the Project a non-exclusive, royalty-free license to display such content within the community context.

Disclaimers

The Services, the website, and all associated content are provided as is and as available without warranty of any kind, express or implied.

To the fullest extent permitted by applicable law, the Project expressly disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of any content, market data, or information provided through the Services.
• Any warranty that defects in the Services will be corrected.

Market data displayed on the website (price, market cap, holders, liquidity) is sourced from third parties and may be delayed, inaccurate, or unavailable. Do not rely on this data for trading decisions.

Limitation of Liability

To the maximum extent permitted by applicable law, the Project, its contributors, team members, and affiliates shall not be liable for any:

• Loss of funds, tokens, or cryptocurrency of any kind.
• Loss of profits, revenue, data, goodwill, or business opportunity.
• Indirect, incidental, special, consequential, exemplary, or punitive damages.
• Damages arising from unauthorized access to or alteration of your wallet or data.
• Damages arising from the conduct of third parties, including exchange operators, market makers, or other token holders.
• Damages arising from smart contract vulnerabilities, blockchain forks, network congestion, or protocol changes outside our control.
• Damages arising from reliance on information published on the website, including market data or roadmap projections.

In jurisdictions that do not allow the exclusion or limitation of liability for certain types of damages, the Project liability shall be limited to the maximum extent permitted by applicable law. In all cases, the Project total aggregate liability to you shall not exceed the greater of (a) USD $100 or (b) the amount you have directly paid to the Project in the preceding three months (if any).

Indemnification

You agree to indemnify, defend, and hold harmless the Project and its team members, contributors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your access to or use of the Services.
• Your violation of these Terms.
• Your violation of any third party rights, including intellectual property rights.
• Your violation of any applicable law or regulation.
• Any content you post or transmit through community channels.
• Any fraudulent, negligent, or willful misconduct on your part.

Third-Party Services and Links

The Services contain links to and integrations with third-party platforms including STON.fi, TonRaffles, Dexscreener, Telegram, and Tonviewer. These services are independent of the Project and governed by their own terms of service and privacy policies.

The Project makes no representations or warranties about the accuracy, availability, legality, or security of third-party services. Links to third-party platforms do not constitute endorsement. You access third-party services at your own risk.

The Project is not responsible for any losses arising from your use of third-party services, including but not limited to: exchange failures, DEX exploits, wallet provider issues, or Telegram service disruptions.

Modifications to Terms and Services

The Project reserves the right to modify these Terms at any time. When material changes are made, we will:

• Update the Last updated date at the top of this page.
• Post an announcement in our official Telegram community channel.

Your continued use of the Services following the posting of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Services.

The Project also reserves the right to modify, suspend, or discontinue any part of the Services, including the website, game, Telegram bot, or airdrop program, at any time, with or without notice, and without liability to you.

Termination and Suspension

The Project may, at its sole discretion and without prior notice, suspend or permanently terminate your access to all or part of the Services for any reason, including but not limited to violation of these Terms, suspected fraudulent or harmful activity, or legal and regulatory requirements.

Upon termination, all rights granted to you under these Terms immediately cease. Provisions of these Terms that by their nature should survive termination, including disclaimers, limitation of liability, indemnification, and governing law, shall survive.

You may discontinue use of the Services at any time by ceasing to access them and, where applicable, unsubscribing from @tsunonton_bot.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with generally applicable principles of international commercial law, with particular reference to principles widely adopted in digital asset and software service contexts, to the extent not in conflict with mandatory provisions of applicable local law.

In the event of a dispute arising from or related to these Terms or the Services, the parties agree to first attempt resolution through good-faith negotiation via the contact channels in Section 18, allowing a minimum of 30 days for resolution before pursuing any other remedy.

Nothing in this section limits any rights you may have under mandatory consumer protection or data protection laws applicable in your jurisdiction. If any provision of these Terms is found to be unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
